1. Introduction, scope & updates

These Terms of Use ("Terms") govern your access to and use of the websites, mobile sites, applications and services provided by Accumulative Wealth (collectively, the "Sites" or "Services"). By using or accessing the Sites you agree to these Terms. If you do not agree, you must not use the Sites.

We may update these Terms from time to time. The "Last revised" date at the end of this page shows when these Terms were last updated. Continued use after updates constitutes acceptance of the revised Terms.

2. Eligibility

You confirm that you are at least 13 years old. If you are under the age of legal majority in your jurisdiction, you must use the Sites only with the consent of a parent or legal guardian.

We strive to keep the Sites available but do not warrant uninterrupted access. The Sites may contain links to third-party websites or resources; those links are provided for convenience only and we are not responsible for third-party content, privacy practices, or terms.

7. Accounts and e-commerce

Certain features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If you provide payment information for services or purchases, you agree to the applicable payment terms and authorize any recurring charges you have approved.

All content and materials on the Sites (including text, graphics, logos, images, and software) are the property of Accumulative Wealth or its licensors and are protected by intellectual property laws. From time to time the Sites may host promotions, contests or surveys. Additional rules and eligibility requirements may apply to those events and will be disclosed where applicable.

12. Certain services and sensitive data

Some features may request or permit disclosure of sensitive personal information (for example, precise geolocation, biometric data). By providing such information you expressly consent to its processing as described in our Privacy Policy. If you do not consent, do not provide that information.

13. Disclaimers of warranty

The Sites and all content are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Accumulative Wealth disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by applicable law, Accumulative Wealth and its affiliates will not be liable for any indirect, incidental, consequential, punitive, or special damages arising from or related to your use of the Sites. Our aggregate liability for direct damages will not exceed the greater of (a) the fees you have paid to us in the 12 months preceding the claim, or (b) €100 (or equivalent), except where otherwise required by law.

15. Indemnity

You agree to indemnify, defend and hold harmless Accumulative Wealth, its officers, directors, employees, agents and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of your violation of these Terms or your use of the Sites.

16. Dispute resolution and arbitration

Please read this section carefully: it affects your rights.

Except where prohibited by applicable law, you and Accumulative Wealth agree that any dispute, claim or controversy arising out of or relating to these Terms or the Sites shall be resolved primarily through binding individual arbitration administered by a recognized arbitration provider, and not by way of court litigation or class action, except that either party may bring claims in small claims court for disputes within that court's jurisdiction. Arbitration limits discovery and may have different rules and remedies than court.

If you prefer not to resolve disputes by arbitration, you must not use the Sites (and your only remedy is to stop using them).

17. Termination

We may suspend or terminate access to the Sites at any time for any reason, including for violation of these Terms. Sections that by their nature should survive termination (for example, indemnity, intellectual property, limitation of liability, dispute resolution) will survive.

18. General

These Terms constitute the entire agreement between you and Accumulative Wealth regarding the Sites, and supersede prior agreements. If any provision is found invalid, the remaining provisions will remain in full force. Headings are for convenience only and have no legal effect.

19. Governing law

These Terms are governed by the laws of Switzerland without regard to its conflict of law rules. Any court proceedings necessary to enforce these Terms or arbitration awards (to the extent permitted) shall be brought in a competent court in Geneva, Switzerland, unless arbitration applies as described above.
